Privacy Notice

GoGiveMe Ltd., registered in the U.K. (referred to as “GoGiveMe,” “we,” “our,” and “us”) provides this Privacy Notice (“Notice”) to explain how we collect, use, and disclose information about you when you interact with us offline and on any products or services on which we make this Notice available. The “Services” refers to all the products and services that we offer, including for example, when you use our mobile applications; raise funds on GoGiveMe for your fundraisers; or donate to one of our non-profit customers through our suite of online fundraising tools for nonprofits (“Business Software”).

Depending on the context, “you” might be a User or a Business Client:

  • Users: Our users who donate on GoGiveMe.com or our users who donate through the Business Software used on our customer’s websites with whom we have a direct relationship when we collect their information under this Notice.
  • Business Clients: Our non-profit customers that use our Business Software.

Before you access, use, or submit any information through or in connection with the Services, please carefully review this Notice. By using any part of the Services, you acknowledge that you have read and understood that we may collect, use, and disclose information about you as outlined in this Notice. To the extent allowed by law, the English version of this Notice is binding, and its translations in other languages are for convenience only; in case of discrepancies between the English version of this Notice and its translations, the English version shall prevail.  

This Notice does not cover the privacy practices of (i) organisers of GoGiveMe fundraisers (collectively, “Organizers”), (ii) beneficiaries of fundraisers (collectively, “Beneficiaries”), or (iii) Business Clients. We are not responsible for the privacy practices of Organizers, Beneficiaries, or Business Clients, and their handling of your information may be subject to their own privacy statements. This Notice also does not cover our data practices when we act as a “processor” or “service provider” on behalf of Business Clients, nor does it apply when we receive donor information from a Business Client to provide the Services, without having a direct relationship with the donors themselves. In those circumstances, we process information about these donors on behalf of the Business Client, and these donors should consult the privacy statement of the respective Business Client they donated to for information on their privacy practices.  

A. Information That You Provide Directly to Us or Our Vendors:

GoGiveMe and its service providers collect information directly from you when you interact with the Services in various ways, including:

  • Account Creation and Use: When you sign up, log in, and use the different features of the Services. This includes basic account details like name, email, login information, location (zip code, country), phone number, and optional profile details (picture, date of birth). For organizations, this includes organization name, your role, tax ID, non-profit status, logo, and mission statement.
  • Fundraiser Creation: When you set up a fundraiser, including the title, category, images, videos, description, and fundraising goal.
  • Financial Transactions: When you provide payment information for donations, withdrawals, and transfers, including bank account details and billing information. GoGiveMe uses third-party payment processors like PayPal to handle these financial details. These processors also collect data directly from you (including transactional data and device information) and act as both processors for GoGiveMe and independent controllers of your data for purposes like fraud detection and analytics. You are encouraged to review their individual privacy policies.
  • Public Communications: When you post comments, feedback, thank-you notes, or communicate with other users on public fundraiser pages. Be aware that this information is public by default.
  • Surveys and Feedback: When you participate in surveys or provide feedback about the Services.
  • Feature Requests: When you request specific features like newsletters and updates.
  • Contests and Events: When you sign up for contests, awards, and events hosted by GoGiveMe.
  • Support and Troubleshooting: When you communicate with GoGiveMe for support, reporting issues, or troubleshooting.
  • Peer-to-Peer and Team Pages: When you create these types of fundraising pages.
  • Event Tickets and Merchandise: When you register for or purchase tickets or merchandise through the Services.
  • Setting up Automated Clearing House (ACH) Transactions: When you authorize these types of payments.
  • Donating: When you donate to any fundraiser, organization, or cause through the Services.

The information you directly provide can be about yourself or others and may include:

  • Account Registration Information: As detailed above (name, email, login, location, phone, profile picture, DOB, organizational details).
  • Fundraiser Information: As detailed above (title, category, media, description, goals).
  • Financial Information: As detailed above (payment details, billing information, handled by third-party processors).
  • Publicly Available and Non-Publicly Available Communications and Content: Your comments, feedback, and notes shared through the Services, noting that public posts are viewable by everyone. GoGiveMe reserves the right to monitor and remove content deemed inappropriate.
  • Information about Yourself and Others, Including Sensitive Information: Details about a fundraiser, its beneficiary, goals, and the circumstances motivating the fundraiser. This can include sensitive information like political opinions, race, ethnicity, health information, or religious beliefs, especially if you choose to post it publicly in a fundraiser. If you upload contacts, GoGiveMe may collect their name and email/phone number with your consent. You agree you have the authority to provide information about others and have informed them how GoGiveMe uses their data. GoGiveMe may identify you as the referrer. GoGiveMe may process sensitive information that you have made public, subject to applicable law.
  • Chats and Other Communications with Us: Transcripts of chats for support and interactive features, which may be retained for training and quality assurance. You are advised not to share sensitive personal data (financial, health, minor’s data without consent) through these channels. By providing such information, you consent to its processing by GoGiveMe and its vendors.
  • Biometric Information: GoGiveMe sometimes uses vendors for identity verification that may collect a copy of your government ID and a scan of the photo. With your consent, vendors may use facial recognition to verify your identity and share the analysis results with GoGiveMe. GoGiveMe itself does not access, collect, or maintain biometric information, which is retained by the vendors according to their policies.

B. Information We Collect from Other Parties:

GoGiveMe may receive information about you from various third-party sources to enhance its user database, improve the Services, for verification and fraud prevention, and as otherwise described in this Notice. These sources include:

  • Data Enrichment and Verification Vendors: GoGiveMe may use vendors to supplement and improve the accuracy of its user information.
  • Media Contact and Influencer Databases: GoGiveMe obtains contact details and other personal information of media contacts and influencers from services like Cision and Muck Rack. You can find more information about their data handling practices in the [Cision privacy policy] and the [Muck Rack privacy policy].
  • Payment Processors: GoGiveMe’s payment processors collect and share certain information with GoGiveMe to facilitate payments you make or receive through the platform. For instance, when you donate via ACH, GoGiveMe may use Plaid to access data from your financial institution, such as your name, email, bank information, zip code, and country. By choosing to link your account with Plaid, you grant GoGiveMe and Plaid the right to access and transmit your personal and financial information from your bank. By using Plaid, you agree to your data being transferred, stored, and processed by both GoGiveMe and Plaid according to this Notice and the [Plaid Privacy Policy].
  • Third-Party Services (e.g., Social Media Platforms): The Services may allow you to connect to or log in through Third-Party Services like Facebook, X, LinkedIn, Google, or Apple, or to upload videos using YouTube APIs. By integrating these services, GoGiveMe aims to provide a richer and more personalized online experience. Some features may also allow you to schedule posts on these Third-Party Services through the GoGiveMe platform, but GoGiveMe will only provide the content, and you retain control over when and how these posts are published with your active authorization. When you connect a Third-Party Service account or log in through one, GoGiveMe collects necessary information to enable the connection. As part of this integration, the Third-Party Service may share certain information you’ve provided to them (based on your privacy settings with that service) such as your name, photograph, and other permitted information. GoGiveMe will use, store, and disclose this information according to this Privacy Notice. However, it’s important to remember that the Third-Party Services’ handling of your information is governed by their own policies, and GoGiveMe is not responsible for their privacy practices or actions. For example, uploading a video via the mobile app uses YouTube and is subject to Google’s Privacy Policy and Terms of Service. By using these features, your connections on the Third-Party Services may be able to see your activity. For example, logging in with Meta is subject to Meta’s Privacy Policy and Terms of Service, and logging in with Google is subject to Google’s Privacy Policy and Terms of Service. You are advised to review the terms of use and privacy policies of the relevant Third-Party Service to understand your rights and choices regarding their technologies.

C. Information That is Passively or Automatically Collected:

GoGiveMe automatically receives and stores certain information from your devices and browsers as you use the Services. This collection happens passively without you actively providing the information in each instance.

I. Device & Browser Information:

When you access the Services, GoGiveMe automatically collects details about the devices and browsers you use. This includes:

  • Your cookie IDs
  • Your social network ID (if you log in through a social network)
  • Your mobile device ID
  • Your mobile advertising ID
  • The type of browser or mobile device you are using (e.g., Chrome, Safari, iPhone, Android)
  • The operating system your device or browser is running on (e.g., Apple iOS, Windows, Android)
  • The website you visited before coming to the Services (referrer URL)
  • Your IP address, which is used to estimate your general location (as explained further in “Location Information” below).

GoGiveMe stores this information directly or it is included in databases owned and maintained by GoGiveMe and/or its service providers.

II. Location Information:

GoGiveMe may use your IP address to infer your approximate location, such as your postcode/zip code, city, state/province, and country. This less precise location data is used to:

  • Provide you with a better browsing experience.
  • Suggest potential donations or tips.
  • Recommend fundraisers or community activities in your general area.
  • For other purposes outlined in this Privacy Notice.

When you organize a fundraiser, you may be required to provide your postcode/zip code, city, and state/province. Please be aware that this information will be visible to other users of the Services in connection with your fundraiser.

If you install GoGiveMe’s mobile application, you may be asked to grant access to your device’s precise geolocation data. If you allow this, GoGiveMe may collect and use this precise location information to improve the Services, such as:

  • Pre-populating your postcode/zip code.
  • Identifying fundraisers near you.

You may also grant location access through your web browser settings. Some devices and operating systems allow you to opt out of providing precise geolocation. Check your device settings to limit this tracking. For questions about your device’s privacy settings, it’s recommended to contact the device or operating system manufacturer.

GoGiveMe may also use your imprecise or precise location information in an aggregated form, as described in the “Aggregated Data” section of the Privacy Notice.

III. Site Usage & Session Information:

GoGiveMe collects information about how you interact with the Services, including:

  • The resources you access.
  • The pages you view.
  • The amount of time you spend on each page.
  • How you arrived at the GoGiveMe website.

GoGiveMe may also use session replay technology to record and log details of your website visits in real-time, including:

  • Mouse movements
  • Clicks
  • Taps
  • Swipes
  • Page visits
  • Time spent on pages
  • Other actions you take on the website
  • Information you view

This information may be shared with GoGiveMe’s service providers for analysis and organization of the collected data on GoGiveMe’s behalf and under its direction.

IV. Cookies & Other Electronic Technologies:

For detailed information about the types of cookies and other electronic technologies GoGiveMe and its vendors use on the Services, how they are used, and your choices regarding them, please refer to the “Online Analytics and Tailored Advertising” section below and the [Cookie Policy](link to cookie policy).

Consequences of Not Providing Information:

If GoGiveMe is unable to collect your information, it may not be able to provide you with the Services or adequately assist you with your questions.

OUR USE OF INFORMATION COLLECTED

GoGiveMe uses the information collected from the Services in a manner that is consistent with this Notice. We may use the information that you provide (or otherwise permit the Services to access) for the following purposes:

  • Provide, operate, and maintain the Services, including to register and maintain your account, facilitate the Know Your Customer (KYC) verification process and to complete transactions;
  • Communicate with you for various purposes, including to help you fundraise more, or for administrative purposes (e.g., to provide services and information that you request or to respond to comments and questions) regarding the Services;
  • Request your feedback;
  • Personalization, marketing, and advertising;
  • Analyze, improve, modify, personalize, and measure the Services, including to optimize our websites, and develop and train our artificial intelligence(AI)/machine learning models as described in more detail below;
  • Develop new products and services and other research and development;
  • Verify your identity and to detect and prevent fraud or other misuses of the Services;
  • Maintain the security of your account and any associated fundraisers;
  • Comply with legal obligations, law enforcement requests and legal processes, and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other parties, including to enforce our Terms of Service and any other agreements; and
  • Carry out any other purpose for which the information was collected.

We may use the information we collect from you, like the NPOs or fundraisers you have donated to, the NPOs or fundraisers you have pinned or added to your lists, the causes you have selected or the people you follow, to draw inferences based on your profile and interactions with our Services. These inferences help us personalize your experience. For example, we may infer what you are interested in based on the causes you have donated to and will provide recommendations to you based on these inferences. In some instances, we may rank content more highly in your feed if it relates to a cause that we infer interests you.

We may also use certain data we collect through the KYC verification process, such as your date of birth, to suggest that you launch a birthday fundraiser. You can opt-out of these marketing communications at any time. For details on managing your preferences, see the “Your Choices” section below.

We may combine information that we collect from you through any or all of the Services with information that we obtain from other sources. For example, we may compile information from a variety of sources to generate inferences about you, such as inferences about your likely interests in making charitable or other donations and the potential size of such donations, starting peer-to-peer fundraisers, and signing up for recurring donations or other similar indicators.

We may also aggregate and/or de-identify information collected through the Services. We may use and disclose de-identified or aggregated data for any purpose, including, without limitation, research and marketing purposes.

We may communicate with you regarding your GoGiveMe account by SMS, MMS, or text message. For example, when setting up your GoGiveMe account, if you click “Send code” by “Text Message,” you agree to receive automated and nonautomated text messages related to your account from or on behalf of GoGiveMe at the phone number provided. You can reply STOP to such text messages to cancel, except for automated text messages related to the security of your account. Message frequency will vary. Except when we collect mobile numbers on behalf of Business Clients on their websites, we do not share mobile phone numbers with any third parties for them to use for their own marketing/promotional purposes. If we intend to share a mobile number in other instances, we will first check with you for any objections before proceeding. We will not use text messaging originator opt-in data or consent for other types of communication (such as email), nor will we share this information with third parties, except as outlined in this Notice. In the event you change or deactivate your mobile telephone number, you agree to promptly update your GoGiveMe account information to ensure that your messages are not misdirected. Please note that your wireless service carrier’s standard charges, message and data rates, and other fees may apply where you access the Services through a mobile device. In addition, downloading, installing, or using certain Services on a mobile device may be prohibited or restricted by your carrier, and not all Services may work with all carriers or devices. For more information, please refer to the SMS Terms of Service.

We may also employ machine learning and other analytics that make inferences about some characteristics of our users to personalise and provide our Services, so that our Services can be more relevant and useful to you. For example, we use tools to tailor emails to you, to show and prioritise causes, fundraisers, and pages we think you’ll be interested in, to protect you and your account from misuse, and to make suggestions about how much you may want to fundraise or donate. If you wish to opt-out of our processing where we offer suggestions on how much you want to donate, like our product Intelligent Ask Amounts, please visit our opt-out form.

Through our vendors, we also may offer certain generative AI features on the Services to help you generate content, like video, text, and social media posts.

GoGiveMe may share the information it has collected about you with other parties, often without providing further individual notice.

A. Business Transfers:

If GoGiveMe is involved in a business transaction such as a sale, merger, reorganization, dissolution, or a similar event, or during the preparatory stages (like due diligence), user information may be reviewed and transferred as part of the business assets.

B. Affiliates and Subsidiaries:

GoGiveMe may share your personal information within its group of companies, including affiliates and subsidiaries. This sharing is for purposes consistent with this Privacy Notice, such as providing the Services (including hosting, marketing, and publicizing fundraisers), offering customer support, managing funds related to fundraisers, preventing fraud and misuse, authenticating donors, sending communications, improving services across the GoGiveMe entities, and other activities described in the Notice.

C. Agents, Consultants, and Vendors:

GoGiveMe engages third-party companies to assist with various business functions. To enable them to perform these services, GoGiveMe may provide access to or disclose your information to these companies. Examples of these functions include marketing, mailing information, data storage, security, identity verification, fraud prevention, payment processing, legal services, and database maintenance. For Business Clients, website and checkout processes are protected by reCAPTCHA, and the Google Privacy Policy and Terms of Service apply to this aspect.

D. Legal Requirements:

GoGiveMe may disclose and preserve your information with courts, law enforcement, governmental or public authorities, tax authorities, or authorized third parties if legally required or permitted, or when reasonably necessary to:

  • Comply with legal obligations.
  • Respond to valid legal requests like subpoenas or court orders.
  • Address claims made against GoGiveMe.
  • Respond to legal requests related to criminal investigations or suspected illegal activity, or any activity that could expose GoGiveMe, you, or other users to harm or legal liability.
  • Enforce and administer the GoGiveMe Terms of Service or other policies.
  • Protect the rights, property, or personal safety of GoGiveMe, its affiliates, employees, users, or the public.

E. Organizers, NPO Beneficiaries, and Business Clients:

  • Organizers: GoGiveMe may share your information with fundraiser Organizers (who may or may not be the Beneficiaries). For example, if you donate to an individual’s fundraiser, your name and donation amount may be shared with the Organizer. If you donate to a Business Client through the Business Software, you direct GoGiveMe to share your donation, contact information, and any other provided information with that Business Client. If you start a fundraiser for an NPO, you authorize GoGiveMe to share your name and email with that NPO.
  • NPO Beneficiaries: When a fundraiser designates an NPO as the Beneficiary, that NPO may access certain information about the Campaign Organizer and donors, including their name, email address, donation amount, transaction date and ID, and campaign name. GoGiveMe contractually requires these NPOs to use this information solely for legal compliance or fundraising communication.
  • Business Clients and Their Vendors/Partners: If you donate to a Business Client through their donation pages powered by GoGiveMe’s Business Software, you instruct GoGiveMe to share your donation and contact information with the Business Client, and this information will also be subject to the Business Client’s privacy policies. Business Clients may also direct GoGiveMe to share your personal information with other third parties they use, such as CRM tools or integration partners, through APIs or webhooks. GoGiveMe may also share certain information about your interests and donation preferences with Business Clients for their fundraising and marketing activities.
  • “Anonymous” Donations Limited to Public Activity Feeds: If you choose not to have your name publicly displayed on the fundraiser page, your donation will appear as “anonymous” in the public activity feed. However, your name and other information may still be visible to the Business Client, Organizer, their team members, and the Beneficiary, and will be processed according to this Privacy Notice.

F. Your Consent:

In specific situations, GoGiveMe may disclose your information if you have given your consent. For example, if GoGiveMe partners with a third-party organization for a specific fundraiser and you consent to sharing your contact information with that partner, GoGiveMe will disclose your name, email address, and other information related to your donation for that fundraiser. Additionally, with the Organizer’s or Beneficiary’s consent, GoGiveMe may provide their personal information to journalists and media to help promote their campaign.

G. Aggregated Data:

GoGiveMe may aggregate, anonymise, and/or de-identify your information so that it no longer directly identifies you. This anonymised data can then be used for various legally permissible purposes, including research on customer demographics, interests, and behavior. GoGiveMe may also share this aggregated data with its affiliates, agents, business partners, research facilities, or other third parties.

H. Cookies and Other Electronic Technologies:

Information collected through cookies and other electronic technologies is disclosed as detailed in the separate [Cookie Policy]. This typically involves sharing data with analytics providers, advertising partners, and social media platforms as outlined in that policy.

I. Other Users of Our Services:

GoGiveMe shares your information with other users of the Services in the following circumstances:

  • Publicly Available Information: If you choose to make your information publicly available in areas of the Services accessible to everyone, such as in the content of your fundraiser, when you make a donation that is not anonymous (depending on the settings), or in the comments you post.
  • Public Profiles and Activity Feeds: If you choose to make your personal profile public, your actions on the Services, such as donating to a fundraiser or starting one, may appear in an activity feed that is visible to individuals who follow you. This allows other users to see your engagement with the platform.

VOLUNTEERED INFORMATION

Please be aware that some information you provide may be publicly accessible, such as information posted in forums or comment sections. When you launch a fundraiser, you make certain information publicly available and thus not protected by certain data protection laws. We also collect information through forums and communities, surveys and customer support communications, your communication to us of ideas for new products or modifications to existing products, feedback, and other solicited or unsolicited submissions (collectively, with publicly-accessible information, “Volunteered Information”). Subject to applicable law, by sending us Volunteered Information, you further agree that we are under no obligation of confidentiality, express or implied, with respect to the Volunteered Information. This Volunteered Information section shall survive any termination of your account or the Services.

ONLINE ANALYTICS AND TAILORED ADVERTISING

Online Analytics. We may use third-party web analytics services on the Services, such as those of Google Analytics. These vendors use the sort of technology described in the “Information That is Passively or Automatically Collected” section above and in our [Cookie Policy] to help us analyse how users use the Services, including by noting the third-party website from which you arrive. The information collected by such technology will be disclosed to or collected directly by these vendors, who use the information to evaluate your use of the Services. We also may use Google Analytics for certain purposes related to advertising, as described in the following section. To prevent Google Analytics from using your information for web analytics, you may install the [Google Analytics Opt-Out Browser Add-on](link to Google Analytics Opt-Out Browser Add-on).

Tailored Advertising. We may allow third-party advertising networks to place cookies or other tracking technologies on your computer, mobile phone, or other device to collect information about your use of the Services in order to (a) inform, optimise, and serve marketing content based on past visits to our website and other online services and (b) report how our marketing content impressions and interactions with these marketing impressions are related to visits to our online services. We may also allow other unaffiliated parties (e.g., ad networks and ad servers such as Google Analytics) to serve tailored marketing to you and to access their own cookies or other tracking technologies on your computer, mobile phone, or other device you use to access the Services. Those parties that use these technologies may offer you a way to opt out of targeted advertising as described below. Cookies may be associated with de-identified data linked to or derived from data you voluntarily have submitted to us (e.g., your email address) that may be disclosed to a vendor in hashed, non-human-readable form.

We may use certain Meta products, such as the Meta Conversion API, on our Services (see our [Cookie Policy] for further information regarding digital advertising and cookies and similar technologies). We may use the product for certain analytics and marketing purposes as described in this Notice, including for measuring the effectiveness of Facebook ads for statistical and market research purposes. Meta Platforms Limited (“Meta”) acts as a joint controller of processing with GoGiveMe within the scope of the General Data Protection Regulation 2016/679 (the “GDPR”) for certain of the processing activities relating to marketing and ad measurements. Information about how Meta processes your information, the legal basis for the processing, and how to contact Meta to exercise your rights with regard to information stored by Meta can be found at https://www.facebook.com/about/privacy.

If you are interested in more information about tailored advertising and how you can generally control cookies from being put on your computer to deliver tailored advertising, you may visit the the Digital Advertising Alliance’s (“DAA”) (Consumer Opt-Out), and/or the (European Interactive Digital Advertising Alliance) to opt-out of receiving tailored advertising from companies that participate in those programs. To exercise choices about how Google personalises Display Advertising or to customise Google Display Network ads, you can visit the Google Ads Settings page. Please note that to the extent advertising technology is integrated into the Services, you may still receive advertising content even if you opt out of tailored advertising. In that case, the advertising content may not be tailored to your interests. Also, we do not control any of the above opt-out links and are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms. If your browsers are configured to reject cookies when you visit these opt-out pages, or you subsequently erase your cookies, or use a different computer or change web browsers, your opt-out may no longer be effective.

CHILDREN

Our Services are not designed for use by individuals under the age of 18. If you are under the age of 18, please do not use the Services and/or submit any information through the Services. If you have reason to believe that a child under the age of 18 has provided personal information to GoGiveMe through the Services, please contact us at contact page, and we will delete that information from our databases to the extent required by law.

Moreover, if you provide us with information about children under the age of 16, you acknowledge and agree that either you are the child’s parent/legal guardian or you have the authority and consent of the child’s parent/legal guardian to create a campaign/fundraiser and for us to access, disclose, and use the relevant data.

LINKS TO OTHER WEBSITES

The Services can contain links to other web sites not operated or controlled by GoGiveMe (the “Third-Party Sites”). The policies and procedures we described here do not apply to the Third-Party Sites. The links from the Services do not imply that GoGiveMe endorses or has reviewed the Third-Party Sites. We suggest contacting those sites directly for information on their respective privacy policies.

SECURITY

We may hold your information we have collected in paper and/or electronic form. While no organization can guarantee perfect security, GoGiveMe has implemented and seeks to continuously improve technical and organisational security measures to protect the information provided via the Services from loss, misuse, unauthorised access, disclosure, alteration, or destruction. RETENTION OF YOUR INFORMATION

We retain your information for as long as we deem necessary for the purpose for which that information was collected and for our legitimate business operations; provided, however, that your information is only retained to the extent permitted or required by applicable laws. When determining the retention period for your information, we take into account various criteria, such as the type of products and services requested by or provided to you, the nature and length of our relationship with you, possible re-enrolment with our products or services, the impact on the Services we provide to you if we delete some information about you, mandatory retention periods provided by law, and any applicable statute of limitations.

CROSS BORDER DATA TRANSFERS

GoGiveMe is a global organisation and GoGiveMe has implemented appropriate cross-border transfer solutions, to provide adequate protection for transfers of certain personal data, such as execution of the Standard Contractual Clauses for transfers of data from the European Economic Area, United Kingdom, and Switzerland to the United States.
